Madras HC cancels land acquisition work for Chennai-Salem highway project

The Madras High Court has quashed land acquisition work for the eight-lane, 277.3 km, Chennai-Salem highway in Tamil Nadu. The Rs 100 billion project is being taken up under the Bharatmala Pariyojana. According to the high court, the project cannot be implemented without prior environmental clearance and has rejected the state government’s claim that the clearance will be necessary only when the actual laying of the road commences. The court has disagreed with the stand of the government to mutate revenue records and transfer government lands, even prior to the issuance of notification under the Land Acquisition Act. Accordingly, the court has ordered the reversal of all mutated land records and communications issued to landowners within a period of two weeks.
